Terms and Conditions

Important notice to clients explaining our Terms of Business and Independent Intermediary Status


Positive Health Brokers Limitedt/as Positive Health Insuranceis an Appointed Representative of Pier Insurance Brokers Ltd (“Pier”) who acts as an Independent Intermediary to arrange insurance products on your behalf. We represent a limited number of insurers, although we may only deal with each insurer for one type of business only. A list of these insurers is available upon request. Sometimes we may operate as an agent of another intermediary for a particular insurance. We are authorised and regulated by the Financial Conduct Authority (“FCA”) and our registration number is 312191 (this can be checked at www.fca.org.uk/register or telephone 0845 6061234). We will not give advice nor make a recommendation on the suitability of any particular product

Professional Indemnity

Pier conforms with the Financial Conduct Authority in respect of Professional Indemnity Insurance. This type of insurance is mandatory for all FCA registered Independent Intermediaries


All information you supply will be kept confidential to Positive Health Insuranceand Pier and the insurers with whom it deals, unless Pier is either required by Law or if we are requested to do so in connection with our membership of the FCA

Proposal Forms

All answers on any Proposal form and any other statements made to us by you are your responsibility. You should always check the accuracy of information provided

Disclosure of Information

It is important that you understand that any information or answers given to us must be correct. Any other matters or information which might influence your Insurer to the acceptability or otherwise of your proposal for insurance or the renewal of it, must be disclosed at the earliest opportunity both before the insurance commences and during the period of the policy. If you do not tell us, then your insurance may not cover you properly or may not operate at all. If you are unsure about any matter you may contact us for guidance as to whether it should be disclosed or not

Awareness of Policy Terms

When a policy is issued, you are strongly advised to read it carefully, as it is that document, the schedule and any certificate of insurance that is the basis of the cover you have purchased. If you are in doubt over any of the policy terms or conditions, please seek our advice promptly


Positive Health Insuranceand Pier reserve the right to make charges, in addition to any insurance premiums for the arranging, amending and cancellation of any policy of insurance. These charges will always be shown and in the event of cancellation are non-refundable


Pier operates a Statutory Trust Bank Account which will undertake co-mingling. Money will however be held by Pier as agent of the insurer where this is appropriate. Payment terms will be advised on each individual case. We may earn interest on client monies, this interest is not refundable to clients


If you have occasion to claim on your policy you must notify us immediately. We will issue you with a claim form, if appropriate, and pass all details to the relevant insurer. You should not admit liability nor agree to any course of action, other than emergency measures carried out to minimise the loss, until there is agreement from the insurer to do so

Warranties & Conditions

When any Warranty or Condition appears in the insurance policy/schedule, it is vital that these are all complied with as any breach of warranty is likely to result in the insurers/underwriters voiding the policy from inception or renewal of the policy. Positive Health Insurance and Pier cannot be held liable for any breach of warranty

Complaints Procedure for Clients

If for any reason you are unhappy with our service or insurance arrangements, please contact our principal in writing at Pier Insurance Brokers Ltd, Astra House, Christy Way, Southfields Business Park, Laindon, Essex, SS15 6TQ, or by telephone on 0845 890 1565. Your complaint will be acknowledged in writing within 5 working days of receipt. Within 4 weeks a full written response answering your complaint will be made, however if the complaint cannot be resolved within this timescale we will write with an explanation as to the progress and the likely timescale involved, where this is within our influence. This process is repeated after a further 4 weeks at which stage if you are still not satisfied you may refer the complaint to the Financial Ombudsman Service

Financial Services Compensation Scheme

You may be covered by the Financial Services Compensation Scheme. You may be entitled to compensation from the scheme if we cannot meet our obligations. This depends on the type of business and the circumstances of the claim. Insurance advising and arranging is covered for 100% of the first £2,000 and 90% of the remainder of the claim, without any upper limit. For compulsory classes of insurance, insurance advising and arranging is covered for 100% of the claim without any upper limit
